This Privacy Notice governs Bike Point Bali's privacy policy when you interact with us in connection with a scooter or motorcycle rental booking. BY USING ANY OF OUR WEBSITES, APPS, AND PLATFORMS, YOU UNDERSTAND AND ACKNOWLEDGE THAT WE WILL COLLECT AND USE YOUR PERSONAL INFORMATION AS DESCRIBED IN THIS PRIVACY NOTICE.

OVERVIEW & SCOPE
Our websites and apps are not intended to allow Bike Point Bali to knowingly collect personal information from minors. If, however, you believe that your child has provided us with their personal data, please contact Bike Point Bali.

INFORMATION WE COLLECT AND HOW IT IS COLLECTED
We collect personal information from you directly and through third parties in accordance with this Privacy Notice when you contact us, interact with us in person or online through our website, social media or apps, or use our products or services. Other sources of information include sites we partner with, information obtained from our affiliated companies, or information you provide when you participate in events or certain promotions. If you do not provide some of the information requested, we may not be able to provide you with the level of service you would expect from Bike Point Bali. When renting a vehicle or using another Bike Point Bali service, we may collect the following information:

  • Personal Information and Identity Verification. Some of the information we collect may identify you personally (or your device), including, for example, your IP address (to determine your location), your name, email addresses, date of birth, your driver's license details, proof of residence, government-issued ID, type of payment information, and, counter photos, insurance information, and Bike Point Bali accounts (including username and password), including past rental history at Bike Point Bali and related accidents, claims, or violations.

  • Transaction Information. Information related to your transaction with Bike Point Bali includes scooter or motorcycle rental information, rental and return location, rental dates, rental type, vehicle preferences, scooter or motorcycle details (e.g., damages), payment information, fees, charges, receipts, additional products purchased, photos of you, claim information, emergency contact information, reservation number, calls recorded for quality assurance. CCTV recordings at the Bike Point Bali office, traffic violations and toll collections, customer service communications, dispute resolution messages, accident or damage claim information, and information you provide regarding your marketing preferences or in the course of participating in surveys or promotional offers.

  • Scooter or motorcycle data. Scooter or motorcycle data includes information such as collision information and information about the operation of the scooter or motorcycle, as well as status, mileage, fuel quantity and other diagnostic information. Depending on the specific technologies or programs available in your scooter or motorcycle, vehicle manufacturers and built-in services and the software may also collect data or other personal or technical information about the scooter or motorcycle in accordance with its privacy policies.

  • Location Information. With your consent, we may access location information (geolocation, zip code, or geographic region) from your mobile device. Also, without further notice, we may use geolocation data from your scooter or motorcycle when it comes to the return of stolen or lost scooters or motorcycles, as well as in the event of an accident or accident.

We manage the social media pages of third parties, place social media and messenger’s icons on our websites. When you visit our social media pages or click on links, as well as when you log in to your account using your Apple or Google credentials, the data is processed by both us and the respective third party. Social media providers, messengers, Apple and Google, are not affiliated with us, and we are not responsible for their content or privacy practices. VEHICLE INFORMATION

We collect and use vehicle data in the following ways:

  • Fuel information is used to monitor the fuel level.
  • The odometer information is used to track mileage.
  • Diagnostic and operational information is used to identify any problems or maintenance needs of the scooter or motorcycle.
  • The VIN or other information, license plate information, or a combination of several types of vehicle data may be legally required by government or regulatory authorities, and we will disclose such information required by law.
  • Automated damage detection services to identify any damage to the vehicle.

INFOTAINMENT & OTHER APPLICATIONS
If you connect your mobile device (or mobile device) to our scooter's navigation or infotainment system, your personal information and other data may be transferred to and stored on these systems, and we cannot guarantee the confidentiality or confidentiality of such information in third-party systems. You are responsible for deleting all such personal information before your scooter or motorcycle is returned.

  • Make reservations for a rented scooter or motorcycle;
  • Register your Bike Point Bali profile, including all Bike Point Bali services, manage and maintain your account or register you in our loyalty program;
  • Process, verify, confirm, verify and monitor your rental bookings (including by processing payment card transactions and contacting you about your booking);
  • Assist in any transactions, including the transmission of important information about a particular transaction or the provision of services;
  • Determine whether you have the right to drive a scooter or motorcycle in Indonesia;
  • Provide third parties (service providers) with information relating to your rental and your specific needs or requests;
  • Keep a record of your bookings and rentals;
  • Respond to your questions and comments and provide support;
  • To inform you about our products, services, offers, events and promotions and to offer you relevant products and services that we think may be of interest to you;
  • Communicate with us through social media and other interactive media;
  • Manage your participation in our events, surveys, sweepstakes, and other promotions;
  • Tailor our products, services and website content to your location and to your personal interests;
  • Operate, evaluate and improve our business and the products and services we offer;
  • Analyze and improve our marketing communications and strategies (including by determining the timing of receiving and reading emails sent to you);
  • Analyze trends and statistics about the use of our websites, mobile applications and social media resources by visitors,
  • Analyze the products that our customers use through our websites and other platforms and adapt our products, services and the content of the website and other platforms accordingly;

We retain your personal data for as long as you have an account with Bike Point Bali, for as long as it is necessary to perform our services or obligations to you, or if it is necessary for the processing purposes for which the information was originally collected. In addition, we will retain your personal information for any legitimate business purposes, including any legal, accounting, archiving or auditing purposes. Depending on the status of the rental transaction, we are required by law to retain some of your personal information indefinitely. Once the retention of personal data is no longer necessary for the purposes set out in this Privacy Notice, we will either delete, de-identify or anonymize the personal data or, if this is not possible (for example, due to the fact that the personal data is stored in backup archives), we will not continue to process the personal data until it is deleted.

INFORMATION WE SHARE
We may share the information we collect with:

  • Companies that provide services on our behalf (e.g., identity verification services, payment processors, or debt collection agencies);
  • Any intermediary you use, such as a travel agency, broker or reservation system, in relation to any aspect of your rental;
  • Our loyalty partners and other business or marketing partners;
  • Financial institutions in connection with payment card transactions;
  • Credit reporting agencies to prevent fraud;
  • Public or private organizations responsible for handling traffic violations;
  • The authority issuing the driving license directly or through intermediary organizations when it is necessary to verify the information about the driving license.
We may also disclose information about you if we are required to do so by law or legal process when we believe disclosure is necessary to prevent harm or financial loss, to assert and defend against claims, or in connection with an investigation of suspected or actual fraudulent or illegal activity.

We may transfer your data to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or shares to such third party, and we will make reasonable efforts to instruct the successor to use the personal information you have provided to us in accordance with our Privacy Notice. Following such sale or transfer, you may contact the entity to which we have transferred your personal data with any questions regarding the processing of that information. We may also share information about you in other ways, of which we provide specific notice when we interact with you.

SERVICE PROVIDERS AND BUSINESS PARTNERS

We are committed to facilitating the exercise of your rights under Indonesian law, which may include the right to request correction, modification or deletion of your personal information and the right to opt out of the sale or transfer of your personal information (as applicable), including in the context of targeted advertising. We will do our best to accommodate your requests in accordance with any legal and contractual obligations.
You can obtain a copy of certain personal information we hold about you, and update or correct inaccuracies in that information, by using the Bike Point Bali account you can create on our website. In addition, if you believe that other personal data, we hold about you is inaccurate, you may request that we correct or change the information, by contacting us as set out in the Contact Us section of our website.
You can request to exercise your rights by sending an email to the email address provided in the contact section of our website. If you submit such a request , we will ask for any additional information about you and your bookings to ensure that you are who you say you are. If this information or these processes are not sufficient to verify your identity and evaluate your request for confidentiality, we may require you to be present at the Bike Point Bali office whose address is listed on our website.

Our websites and platforms may contain links to other sites and platforms for your convenience and information. These sites may be operated by companies not affiliated with Bike Point Bali. Linked sites may have their own privacy notices. We are not responsible for the content of any websites not affiliated with Bike Point Bali, any use of those sites, or the privacy policies of those sites.

DATA TRANSFER
Bike Point Bali is a company registered in Indonesia that is subject to the laws of Indonesia, including those governing the privacy and security of your information. When we receive personal information about you, we may process the information outside of the country in which you are located. The countries in which we process your information may not have the same data protection laws as the country in which you are located. We will protect your information as described in this Privacy Notice.

HOW WE PROTECT PERSONAL DATA
We maintain administrative, technical, and physical security measures designed to help us protect the personal information we collect from accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use.
Please note that no electronic transmission of information can be completely secure. We cannot guarantee that the security measures we employ to protect personal information will never be overridden or fail, or that these measures will always be sufficient or effective. Please note that we will never ask for your Bike Point Baliaccount username or password via email or other means of communication.
To be on the safe side, you should keep your Bike Point Bali account username and password safe and not share this information with anyone. You must not use the same username and password for your Bike Point Bali account as you do for your other online accounts . Using the same login credentials for your online accounts can significantly increase Risk of identity theft and fraud. You are also required to log out of your account and close your browser window after completing your visit to our website.

UPDATES TO THIS PRIVACY NOTICE
This Privacy Notice may be updated from time to time. We will post the updated Privacy Notice on our website, mobile application.
TERMS AND CONDITIONS
1. TERMS AND CONDITIONS
1.1. These terms and conditions (Terms) constitute a legal binding agreement between you, whether in your personal capacity or on behalf of an entity (you) and PT. Bike Point Bali, registered with the law of Indonesia, trading as Bike Point Bali (www.bikepointbali.ru).
1.2 The Terms apply to and regulate your use of the Bike Point Bali platform (PLATFORM) which is available through the website www.bikepointbali.ru (Site). By accessing the PLATFORM through the Site you can book motorbike (MOTORBIKE) rental (MOTORBIKE RENTAL).
The Terms relate solely to the legal relationship between us and you in relation to the PLATFORM. You will also enter into a rental agreement (Rental Agreement) with PT. Bike Point Bali in relation to the MOTORBIKE.
1.3 To book MOTORBIKE RENTAL you must meet the age and other eligibility requirements of the PT. Bike Point Bali, and you must be a holder of valid identity documents (e.g. passport or national ID card), a driving license and a valid debit or credit card.
1.4 MOTORBIKE RENTAL can be booked through the Site immediately, however, the delivery and signing of the Rental Agreement will be carried out during the operational hours of PT. Bike Point Bali. When you make a booking (Booking) request you will be asked to make a prepayment (Booking Deposit). The Booking is only confirmed once that you have received the reservation voucher (Reservation Voucher) to your Email address.
The PT. Bike Point Bali reserves the right to decline a Booking or vary it by proposing an alternative MOTORBIKE. The Reservation Voucher will not be sent to you until you have accepted any proposed variation.
If you fail to pay the Booking Deposit, your booking will be unconfirmed and may be canceled by us at any time. If the Booking is not accepted by PT. Bike Point Bali, the Booking Deposit will be returned to you.
1.5 When you complete the MOTORBIKE RENTAL booking form on the Site you will declare that the information you have given is true, that the credit card used for the payment is your own card, and that there is sufficient credit available on it to cover the full cost of the MOTORBIKE RENTAL which you have booked.
1.6 PT. Bike Point Bali may request an additional confirmation of the credit card details you have provided before confirming your Booking is confirmed. If you fail to provide confirmation of your driving license details, when requested to do so, or to pay the Booking Deposit, your Booking may be canceled.
Additionally, we may deny further access to the Platform to you and claim compensation from you for any losses suffered by us as a result of such failure by you.
1.7 The Reservation Voucher will contain complete information about your Booking the amount of the Booking Deposit paid.
1.8 The Reservation Voucher must be presented by you to the PT. Bike Point Bali upon MOTORBIKE collection. You will not be entitled to compensation, if the MOTORBIKE RENTAL service has not been provided to you due to your failure to provide the Reservation Voucher when requested. You will also not be entitled to compensation if you fail to contact the PT. Bike Point Bali immediately, if you are not able to locate a representative at the meeting point.
1.9 The Booking Deposit will not be refundable if you cancel your Booking outside the cancellation period permitted by the PT. Bike Point Bali in relation to your Booking, or if, in our opinion, you have materially breached these Terms. If there are sums to be refunded to you, the refund will be made after deduction of any amounts paid by us for any administrative and bank fees as well as any charges for order cancellation or amendment applied by the PT. Bike Point Bali.
1.10 A confirmed Booking may only be changed within the cancellation period permitted by the PT. Bike Point Bali in relation to your Booking, and if such change is confirmed by us by email to your specified contact e-mail address. We will apply the following administrative charges, if you modify your Booking: first change - free of charge, second and subsequent changes – 20000 IDR.
Our administrative charges are in addition to any charges which may be applied by the third parties to the PT. Bike Point as a result of the requested changes.
1.11 The extension or reduction of the rental period of a Booking following your collection of the MOTORBIKE can only be made in accordance with the terms of the Rental Agreement and must be requested directly from the PT. Bike Point Bali.
1.12 The minimum period for MOTORBIKE RENTAL is 72 hours.
1.13 PT. Bike Point Bali advertises certain MOTORBIKE models on the Site but cannot guarantee that you will receive the same model and brand. The PT. Bike Point Bali will make reasonable efforts to provide the MOTORBIKE indicated on the Reservation Voucher. However, if necessary and subject to availability the PT. Bike Point Bali may replace it with a similar one of the same or higher class at the same pricing conditions. You will not be entitled to compensation from PT. Bike Point Bali in such a circumstance pursuant to the terms of the Rental Agreement.

2. PRICES AND PAYMENT METHOD
2.1 The prices for the MOTORBIKE RENTAL service are published on the Site and are effective as of the time of your Booking. The MOTORBIKE RENTAL cost will be confirmed in the Reservation Voucher. If, for any reason, the Booking price has not been properly registered in the course of your Booking, you will receive an additional notification regarding any change in the pricing. You may then accept or cancel the Booking through the Site.
2.2 The MOTORBIKE RENTAL price is stated in the Reservation Voucher which forms an inseparable part of the Rental Agreement.
2.3 With signing the Rental Agreement with the PT. Bike Point Bali, the Rental Partner may request payment for any additional services that you have requested with our Customer Client Service.

3. SAFETY PACK AND EXCLUSIONS
3.1 The SAFETY PACK cover for the Booking is provided to you by the PT. Bike Point Bali. Please note that the SAFETY PACK may not cover the following:
• loss or theft of your personal belongings;
• loss of keys and documents of the MOTORBIKE;
• damages caused by the transportation of dangerous goods;
• damages caused by riding off-road and towing other vehicles;
• changed, damaged, flat or cut tyres;
• damage caused by unlicensed and unauthorized drivers;
• damage caused while riding under the influence of alcohol or other intoxicants;
• damage caused by inappropriate repair work not approved by the PT. Bike Point Bali;
• damages caused as a result of using fuel which does not meeting the standards and requirements for the MOTORBIKE;
• damage caused outside the territory to which the Booking relates if the Rental Agreement does not allow you to take the MOTORBIKE outside the Territory;
• loss of, or damage to, additional equipment provided to you and described in the Rental Agreement and in the MOTORBIKE inspection report;
3.2 The amount of your liability in the event of a traffic accident or damage of the MOTORBIKE is itemized in the Reservation Voucher. You will be required to follow the accident protocol set out in the Rental Agreement. Otherwise, you will be responsible for the full amount of the damage to the MOTORBIKE and, in case of theft, for the full replacement value of the BIKE.
3.3 Unless agreed otherwise, the Rental price does not include cost of the fuel. Unless agreed otherwise, you will return the MOTORBIKE with the same amount of fuel in the fuel tank as when you received it. Otherwise you will pay the cost of any fuel top-up required at the price fixed in the Rental Agreement.
3.4 The rental price does not include fines or any other penalties imposed by the relevant traffic control authorities on you or other people during the rental period for non-compliance with the traffic laws or regulations in Indonesia and Bali.
3.5 All online credit card payments made on the Site will be made through fully licensed services and will be secured through the protective technologies. Your personal information will remain strictly confidential. How we handle any personal data collected from you and your rights in relation to such personal data are set out in our privacy policy which can be found at Site - Privacy Policy.
3.6 Payments by credit card or wire transfer may be subject to additional bank processing fees applied.
3.7 In the event of fraud or unauthorized use of your credit card details by third parties as a result of your use of the credit card on the Site, PT. Bike Point Bali will have no liability to you for such fraudulent use. Banks and credit card issuers will typically compensate you for any losses sustained in this circumstance.

4. PICK-UP AND RETURN OF THE MOTORBIKE
4.1 The MOTORBIKE will be delivered to you in good technical condition with the equipment and appearance described in the Inspection Report, which will form part of the Rental Agreement. When you return the MOTORBIKE its condition must be the same as set out in the Inspection Report. Unless otherwise stated in the Rental Agreement and in the Security Package you choose at the time of Booking, you are solely responsible for the cost of replacing missing items or damage to MOTORBIKE. If the MOTORBIKE is returned unclean you will pay all cleaning costs.
4.2 You will collect the MOTORBIKE at the place and the time specified in the Reservation Voucher. The PT. Bike Point Bali may, in its discretion, terminate your Rental Agreement if you fail to collect the MOTORBIKE within 1 hour of the specified collection time. If you fail to find a representative, the PT. Bike Point Bali at the meeting point you should immediately call the phone numbers of the PT. Bike Point Bali provided in the Reservation Voucher.
4.3 PT. Bike Point Bali will not have any liability for losses suffered by you as a result of delay (e.g. missed flight, bus or other) when collecting or returning the MOTORBIKE.
4.4 Upon collection of the MOTORBIKE, you will present a valid international driving license, a valid identity document (a international ID card or passport) and a valid credit card in your name. If you are unable to submit all the above documents and a valid credit card the Booking will be considered canceled due to your fault and you will pay the full amount of the Booking as compensation.
4.5 You will return the MOTORBIKE in the same condition as you collect it with all vehicle documents at the agreed time and place, specified in the Rental Agreement.
4.6 If you delay the return of the MOTORBIKE to a time which is more than 60 minutes from the time specified in the Rental Agreement, you will pay a default amounting to 1 day’s rental payable upon return of the MOTORBIKE.
4.7 Failure to return the MOTORBIKE for more than 24 hours from the time specified in the Rental Agreement for whatever reason, will be considered a misappropriation of the MOTORBIKE and the PT. Bike Point Bali will be entitled to inform the relevant police authorities of your failure to return the MOTORBIKE. In addition, upon your eventual return of the MOTORBIKE you will pay the double daily rental amount for the MOTORBIKE from the contractual return date set out in the Rental Agreement up to the actual return date.
4.8 PT. Bike Point Bali reserves the right to discontinue the Rental, and collect the MOTORBIKE at any time, without notice and at your expense, if the MOTORBIKE has not been used in accordance with these Terms and/or the terms of the Rental Agreement. PT. Bike Point Bali does not bear any responsibility for any additional costs incurred by you and other members of your party as a result of termination of the MOTORBIKE rental.
4.9 If you fail to sign the Inspection Report upon return of the MOTORBIKE, it will be signed unilaterally by the representative of the PT. Bike Point Bali and by a witness attesting the refusal. The findings in the Inspection Report will be binding on you, despite your refusal to sign it and can be used as evidence in court proceedings.
4.10 If the MOTORBIKE fails to operate due to a manufacturing defect or natural wear and tear, the PT. Bike Point Bali will repair the MOTORBIKE or replace it. If the PT. Bike Point Bali does not have a suitable MOTORBIKE to replace the one booked, it will provide you with transportation to the point of return of the MOTORBIKE as set out in the Rental Agreement and you will be entitled to recover the full amount of the Booking.
4.11 In case of MOTORBIKE replacement due to damage caused by you, you will be responsible for paying all costs relating to the replacement of the MOTORBIKE and the rental cost for the out-of-service period of the damaged MOTORBIKE. The PT. Bike Point Bali reserves the right to refuse a replacement MOTORBIKE if you are found to have been in breach of these Terms and/or the Rental Agreement.

5. DAMAGE NOTIFICATION
5.1 In case of an accident, injury or damage you will take all necessary measures for saving, limiting and reducing the damage to the MOTORBIKE, in accordance with the SAFETY PACK of the MOTORBIKE's Rental Agreement. In case of default, damage, theft or missing parts in the MOTORBIKE you will pay a fee as set out with the SAFETY PACK of the MOTORBIKE's Rental Agreement.
5.2 In case of a traffic accident, damage or theft of the MOTORBIKE you will immediately notify the PT. Bike Point Bali, regardless of whether you are the party at fault. You will be responsible for obtaining a full police report in respect of such an incident. If you fail to provide the PT. Bike Point Bali with such a report you will have full responsibility for any loss or damage to the MOTORBIKE or for its replacement, as the case may be.
5.3 Upon returning the MOTORBIKE with damage or parts missing, the insurance deposit (if offered by your Safety Pack) listed in the Rental Agreement will be kept by the PT. Bike Point Bali, and the MOTORBIKE will be sent for inspection by an authorized service shop. Upon completion of the examination, the PT. Bike Point Bali will notify you (at the email address provided in the Booking) and issue an invoice for the cost of the repair work to the MOTORBIKE.

6. YOUR DUTIES AND RESPONSIBILITIES
6.1 You are required:
6.1.1 to take care of the MOTORBIKE and to ensure the normal operation of the engine;
6.1.2 to monitor аll MOTORBIKE operational fluids - oil and coolant level, and not to leave the MOTORBIKE;
6.1.3 not to leave the keys and documents inside the MOTORBIKE;
6.1.4 to use the MOTORBIKE for its intended purpose and with due diligence.
6.2 In the event of termination of the Rental Agreement you will return the MOTORBIKE to the PT. Bike Point Bali in the condition it was received by and without any damage or defects.
6.3 In case you experience any issues with the MOTORBIKE RENTAL, you will immediately notify the PT. Bike Point Bali, using the contact details provided in the Reservation Voucher.
6.4 You are fully responsible for any violations and fines imposed while using the MOTORBIKE as well as for any possible consequences incurred as a result of the breach of the laws of Indonesia and Bali. All fines will be payable by you within 5 days of receipt of a written notice from the PT. Bike Point Bali as sent to the e-mail address provided by you in the Booking.
6.5 You will be fully responsible for the use of the MOTORBIKE by any third party which is not a party to the Rental Agreement.
6.6 All riders must wear protective helmets.
6.7 You are not entitled to use the MOTORBIKE:
• if under the influence of alcohol or drugs;
• for competitions, sports events and driving off-road;
• for tests and experimental driving;
• for rent to, or use by, third parties;
• to carry passengers and goods for commercial purposes;
• for the furtherance of criminal activity;
• for transportation of dangerous goods and towing other vehicles.
6.8 You are not entitled to travel out of the Territory of Bali with the MOTORBIKE.
6.9 PT. Bike Point Bali nor its officers, directors, employees, agents, subsidiaries or affiliated companies, partners are not responsible for any criminal, special, indirect or consequential loss or damage, loss of production, loss of profit, loss of revenue, loss of contract, loss or damage to/of goodwill or reputation:
• for any inaccuracy related to the web pages of the Site;
• for any damages, losses or expenses incurred by you as a result of or in connection with the use, inability to use or delay of PT. Bike Point Bali services;
• for any (personal) injury, death, property damage or other (direct, indirect, special, consequential or criminal) damages, losses or expenses incurred or for which you have been held accountable, or is paid by you, regardless of whether it is due to (legal) actions, errors, unkept commitments (total) failure, deliberate crime, omissions, default, distortions, legal offense or breach of official duties (full or partial) (its employees, directors, agents, representatives or affiliated companies); including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond PT. Bike Point Bali control (e.g. war, threat of war, terrorist activity and its consequences or the threat of such activity, riots, the effect of any government or other national or local authorities, industrial accidents, strike, natural or nuclear disaster, fire, adverse weather conditions, traffic accidents, etc.).

7. MISCELLANEOUS
7.1 These Terms are published on the Site, and may be amended by PT. Bike Point Bali at any time and the changes will be published on the Site and thus available to you. The Terms are effective as of the time of your registration on the Site and are deemed to be accepted by you at the time of your registration on the Site.
7.2 These Terms together with the Reservation Voucher, the Rental Agreement is the entire agreement by and between PT. Bike Point Bali and you. By ticking "I agree with the Terms and Conditions" in the registration form on the Site, you confirm that you have read the Terms, understood their content, agreed and officially accepted them.
7.3 The correspondence between PT. Bike Point Bali and you will be organized as follows:

7.4 The date of receipt of an e-mail message is the date of receipt in the PT. Bike Point Bali email box or the first working day if the message is received during weekends or public holiday.
7.5 Any disputes between you and us related to these Terms will be resolved in good faith and mutual understanding.
